By engaging the services of Rakhecha And Associates ("the Firm", "we", "us", or "our"), visiting our website, or entering into a professional engagement, you ("the Client") agree to be bound by these Terms and Conditions.
These terms constitute a legally binding agreement between the Client and Rakhecha And Associates, a chartered accountancy firm registered with the Institute of Chartered Accountants of India (ICAI) and operating from Judge Bazar, Darjeeling – 734101.
If you do not agree to these terms, please do not use our services or website.
Rakhecha And Associates provides the following professional services:
All services are governed by the professional standards and ethical guidelines prescribed by ICAI. The scope of each engagement will be defined in a separate engagement letter or agreement.
To enable the Firm to provide services effectively, the Client agrees to:
The Firm shall not be held liable for any errors, penalties, or adverse outcomes arising from incomplete, inaccurate, or delayed information provided by the Client.
Fees for services are agreed upon at the commencement of each engagement and outlined in the engagement letter. The following general terms apply:
Disputes regarding invoices must be raised in writing within 14 days of the invoice date.
The Firm treats all client information as strictly confidential. We will not disclose any client information to third parties except:
This confidentiality obligation continues to apply after the termination of the engagement.
All reports, documents, templates, methodologies, and other materials prepared by the Firm remain the intellectual property of Rakhecha And Associates unless otherwise agreed in writing.
The Client is granted a non-exclusive licence to use deliverables prepared for them solely for the purpose for which they were created. Deliverables may not be shared with third parties or used beyond the original engagement without the Firm's written consent.
To the fullest extent permitted by law:
Nothing in these terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded under applicable law.
Either party may terminate an engagement by giving 30 days' written notice, unless a different notice period is specified in the engagement letter.
The Firm may terminate with immediate effect if the Client fails to pay outstanding fees, provides false information, or continuing the engagement would breach professional or ethical obligations.
Upon termination, the Client remains liable for all fees incurred to date. Original documents will be returned upon receipt of outstanding fees.
These Terms and Conditions are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Darjeeling, West Bengal.
The Firm and the Client agree to attempt to resolve disputes in good faith through mutual discussion before initiating formal legal proceedings.
